TERMS AND CONDITIONS
My Credit Plan is managed through an exclusive license by Family Financial Education Foundation (FFEF), a 501(c) (3), non-profit organization. My Credit Plan (MCP) is licensed by FFEF to provide each consumer valuable insight and critical information. They are considered one and the same in the Terms and Conditions.
Equifax, Experian, TransUnion, and FICO are registered trademarks. My Credit Plan is copyright protected and has patents pending.
SERVICE AGREEMENT
Welcome to the MCP web site, www.MyCreditPlan.org, (the "Site"). This Service Agreement ("Agreement") contains the terms and conditions upon which you ("you," or the "member") may access and use MCP or any products through the Site. You agree to be legally bound by these terms.
FFEF, MCP and any of their affiliates are not affiliated with any credit repair organization, or similarly regulated organization under other applicable law, and does not provide credit repair services. FFEF nor MCP will never claim to "clean up" your credit record, credit history or credit rating, nor dispute derogatory items in your credit report in actions similar to a credit repair organization.
MCP and FFEF has the specific right through the directive from the Consumer Financial Protection Bureau to offer “Lender’s” credit reports and credit scores as of April 21, 2015 under the heading “Millions of consumers will now have access to credit scores and reports through non-profit counselors”. It reads in part;
"All three major credit reporting agencies (Experian, Equifax and TransUnion) will now allow nonprofit counselors to share credits reports, as well as the scores, with the consumer.
Millions of consumers will now be able to receive the credit scores and credit reports that nonprofit credit counselors purchase on their behalf.
Nonprofit organizations that offer credit counseling, housing counseling, and other financial counseling services buy credit reports and scores for the consumers they serve. These reports and scores help counselors engage in constructive conversations with their clients about steps the clients can take to improve their financial situation."
MCP follows this directive to provide direct to consumer access to their lender's credit report and FICO credit scores. It also provides additional services to provide further education about different mortgage, auto loans, and other financial services, along with a plan for personalized credit score improvement for the 3 Classic FICO credit scores.
CREDIT REPORT AUTHORIZATION
In order to provide credit, housing and other loan counseling, MCP must access your
credit file with each of the national credit reporting agencies; Equifax®, Experian®, and
TrasnUnion®. In the given sequences of authorization, you grant MCP and FFEF the
right to request and access to your consumer credit report from your given selection.
The initial credit report at the onset of setting up your account, will usually be a request
for a “tri-merge” credit report from all three national credit reporting agencies.
Subsequent requests will be made following your selection.
These credit reports will be obtained through third-party secondary credit reporting
agencies who compile and send the report and credit scores to MCP. Such credit
reports are often referred to as a ‘Lender’s credit report’ since many lenders utilize this
type of credit report to determine your qualifications for a loan product or other financial
services. This credit report and credit score(s) may or may not be the same information
all lenders utilize.
MCP will request your credit report and credit scores following your authorization and
selection of your credit score improvement plan. You may change, update, cancel or put
on inactive status your subscription with MCP by assessing your personal account
settings and selecting the appropriate option for you. You may make multiple changes to
your active subscription without any charge, except to re-activate your account when a
reactivation fee may be assessed.
My Credit Plan requires additional identity verifications through government-issued
picture identification and other secondary validations. You agree to provide this
information to MCP and FFEF . Failure to provide this information or correctly answer
the questions provided will not allow you to access your account, your credit report and
credit scores until MCP and FFEF successfully validates your identity.
CREDIT SCORES
The credit scores provided are commonly referred to as the ‘Classic FICO® credit
scores’, or the FICO version 2, FICO version 4, and the FICO version 5. These are the
main credit scores used by all mortgage lenders, and most auto and credit card lenders.
If lenders migrate to another credit score version, MCP will migrate to the new credit
scores.
The credit scores requested through MCP may be different than the credit scores utilize
by your lender since credit scores can change from day to day, and some lenders utilize
a different credit score model.
MCP will access your credit reports and FICO Scores from the major credit agencies
upon your request. MCP is NOT liable for any request for your credit report and credit
scores that is unfulfilled (through no fault of MCP) as a result of having the credit file
frozen with the credit agencies, or a failure of the credit agencies to provide the
complete credit report / score. MCP will try to access one additional time any unfulfilled
credit report / score upon request from a consumer.
MCP’s Planner is the plan-of-action for credit score improvement. Through this analysis,
MCP will provide a personal plan of action in an effort to improve your 3 Classic FICO
Scores. The results will vary and the estimated point improvement is only an estimate.
You will NOT hold MCP and or FFEF liable in any situation if the credit score analysis is
under or over the final score adjustment.
SUBSCRIPTION
During initial signup, you may select further update, a 1-score monthly update, a 2-
score monthly update, or a 3-score monthly update. MCP will update and provide your
Scores each month based on your selection. You authorize MCP to charge the credit
card provided each month based on the program you have selected. You may change
your monthly subscription by clicking on your personal account settings, and selecting a
change to you monthly subscription. You may cancel your monthly subscription at any
time without additional charge.
My Credit Plan will email each active account’s enrolled member a few days in advance
of each monthly update to that person’s credit report and scores to notify of the next
update. MCP is NOT liable or responsible in case the email address provided is
incorrect, has changed, or the email is not received by that member.
Your subscription automatically renews indefinitely without action by you and the fee is
charged to the given credit card provided to your account at the time of renewal. An
enrollee whose “Gold” membership fee has been paid is entitled to all privileges
included in the membership into MCP. A “Silver” membership will entitle the member to
have access to your lender’s 3-bureau credit report, 3 Classic FICO Scores, and MCP’s
analysis and tracker.
You have rights to this membership until the membership is cancelled by you or
otherwise terminated as described later in this document. Consent to obtain credit data
to fulfill the benefits of subscription products shall be valid under the program until
cancelled. Upon cancellation of your account, you lose access to Mortgage 850, Auto
Loan 850, MCP analysis, plan-of-action, and tracking programs.
MCP and FFEF will charge the monthly membership fee to the credit card or bank
account you designated as your preference or, if you have not designated a preference,
the account that was most recently used and your membership will continue
automatically, monthly at the prevailing rate. Should your billing account fail to
authorize, you will be notified via email immediately. The benefits of your membership
including, without limitation to online credit report and FICO Scores will be suspended
until your payment is received.
All credit reports requested by MCP are done through FFEF and will most likely appear
on your credit report inquiry section with the credit agencies. A soft inquiry will appear
on your credit report which should NOT impact your FICO Scores.
ANALYSIS
MCP offers several resources to help you. The Analyzer provides analysis on your
credit report based on the nearly three-dozen FICO Scores factors. The Planner offers a
personal plan-of-action to help you identify appropriate steps to improve your 3 FICO
Scores. The average score improvement is based on the best result of the three scores
from a person’s 3 Classic FICO Scores. The Qualifier provides insight to mortgage and
auto loan qualification. MCP and FFEF is not a lender and is not authorized to formally
approve a loan for you.
MCP, including all content, products and services available on or accessed through this
site and its various web pages and products, is provided to you “As is” to the fullest
extent under the law. MCP utilizes the services of third parties such as secondary credit
agencies, mortgage lenders, auto lenders, mortgage insurers, the Federal Housing
Financial Agency, Housing and Urban Development, the Veteran’s Administration, and
the United States Department of Agriculture.
These entities provide the information on credit reports and FICO Scores, possible
mortgage and auto qualifications, interest rates, mortgage insurance premiums,
derogatory credit information and all other criteria. MCP and FFEF is not responsible for
shared erroneous information or an inconsistent reading from MCP’s analysis that may
change your loan qualification. Interest rates and mortgage insurance premiums may
vary from lender to lender. My Credit Plan is trying to provide additional points of
analysis that may / may not assist you with your loan.
The information on this website, MyCreditPlan.org is for education purposes only. MCP
and FFEF are not lenders. MCP and FFEF make every effort to provide you correct
information, but MCP and FFEF does not provide guarantees or warranties to the
accuracies of any kind as to the content, products, or services on this website.
You will have access as an active member account to the programs, services and
products on this website. In certain circumstances where MCP partners with other
entities, access points to certain analysis will only be available through MCP and that
entity’s services.
SERVICE
You agree that access to MCP and use of its products, services and offerings are at
your own risk. You agree and acknowledge that MCP and FFEF nor any of its affiliates
have any liability to you, whether based in contract, tort, liability or otherwise for any
direct, indirect, incidental, consequential or any damages arising from use of the
services and products of MCP, including the possibility of service disruptions or
computer viruses that may cause damage to any computer equipment.
COPYRIGHT AND PATENTS
FFEF maintains MyCreditPlan.org in an effort to provide you with useful information
about the listed services and products. From time to time, FFEF may revise the terms
and conditions of MCP. Revisions will be effective when posted or as otherwise stated.
Additional terms and conditions may apply to specifics of those currently enrolled into
MCP, and / or products and services to participate in our affiliate program, and partner
relationships.
The images, text, screens, web pages, materials, data, content and other information
("Content") used and displayed on MCP, is copyright and (all applicable) patent
protected, and the property of FFEF, licensed to be used by FFEFs’ purposes. MCP and
FFEF does NOT sell your information to outside entities. MCP may partner with for-
profit and non-profit entities to provide additional analysis and insight to mortgage and
auto loans. This analysis is based solely on an effort to provide greater information to
you about different loan products and options. MCP and FFEF will NOT share any
personal information with partnering entities. MCP may share certain non-personal
information with designated partners only after receiving your authorization.
You may copy the content from MCP for your personal or educational use only, provided
that each copy includes any copyright, trademark or service mark notice or attribution as
they appear on the pages copied. Except as provided in the preceding sentence, none
of the content from MCP’s analysis may be copied, displayed, distributed, downloaded,
licensed, modified, published, reposted, reproduced, reused, sold, transmitted, used to
create a derivative work or otherwise used for public or commercial purposes without
the express written permission of Family Financial.
PRIVACY POLICY
If you decide to register and purchase products and services on our Site, you may be
required to register, provide personal information, select a user name and password.
You agree to provide accurate information in your registration and not to share your
password with third parties. You agree not to impersonate another person or to select or
use a user name or password of another person. You agree to notify Family Financial
promptly of any unauthorized use of your account and of any loss, theft or disclosure of
your password.
Failure to comply with these requirements shall constitute a breach of these terms and
conditions and shall constitute grounds for immediate termination of your MCP account
and the right to use the Site. Online access to your credit report information and FICO
scores is subject to verification of the identity of the user through government-issued
picture identification and / or reverse identification questions. You agree to provide this
information to FFEF in the online portal of MCP to validate your identity. Failure to
provide this information will place a hold on access to your account on this Site.
It is the policy of MCP and FFEF to ensure an appropriate level to protect your personal
information to prevent unauthorized access including password changes, government-
issued picture identification, reverse question identification, and encryption. It is the
practice of FFEF to utilize appropriate levels of security by restricting access to data
including secured storage facilities, and utilizing security measures into equipment and
programming in which this data is held. FFEF utilizes the professional services of
outside entities to maintain and build additional programming for MCP. Multiple layers of
security are added and additional measures are taken to ensure that only competent,
integrity and prudent individuals have access to this information. You agree to hold
harmless FFEF and MCP in the event of a breach or in the event you share your user
ID, password, and other personal information with a separate individual that may / may
not cause personal harm to you. You are obligated to immediately contact Family
Financial in the event someone else has accessed your account with MCP.
Your personal information is not given nor sold to any outside party. You may authorize
MCP to share certain information such as potential loan qualifications with outside
professionals only upon your specific approval to do so. No personal information such
as social security numbers, or other credit-related information will be shared with any
unauthorized outside entity or professionals. You retain the right to revoke this privilege
to share this information with outside professionals at any time by contacting FFEF.
FAIR CREDIT REPORTING ACT
The credit report requested by MCP is a ‘credit report used by lenders” and usually
contains additional information from the free consumer credit report you are allowed to
receive from the Fair Credit Reporting Act. This Act allows you to obtain a free
consumer credit report from each credit reporting agency annually. The credit reports
provided or requested through our Site are not intended to constitute the free credit
report by a credit reporting agency as required by the Fair Credit Reporting Act or
similar laws.
CANCELATION
This Agreement will take effect at the time you click "I Accept," when a credit card
payment is accepted, and shall terminate (a) when the member cancels his/her
membership by canceling the subscription in the account settings, by contacting My
Credit Plan / Family Financial through the number located on the web site, or by
emailing us at Support@MyCreditPalan.org.
With the cancelation of your account, your membership and access to MCP will no
longer be available. The monthly fee in which the time the account is cancelled will not
be refunded in any amount since the service has already been provided. You may
reactivate your account within 30 days without having to pay any additional fee to
reactivate your subscription.
MCP products shall not be used in any manner that defrauds or otherwise abuses the
credit reporting or credit scoring systems. FFEF retains the right to suspend or
terminate your use of any product or access to MCP if it is determined, in our sole
discretion, that your use of our products has abused the credit reporting or credit
scoring systems. If such action occurs, you agree that FFEF will not be liable to you or
any third party if we suspend or terminate your account access for any reason.
FFEF may (i) change the terms of this Agreement or the feature of the membership
products, or (ii) change to MCP, including eliminating or discontinuing any content or
feature of the Site, restricting the hours of availability, or limiting the amount of use
permitted, by posting notice of such modification on a page of the Site before the
modification takes effect. All changes shall be effective immediately upon posting of
such notice. If you use the Site and/or your membership after TrueCredit has notified
you of a change in the Agreement, you agree to be bound by all of the changes. You are
expected to review the updated Terms and Conditions periodically to ensure familiarity
with any updated notices of modification.
NOTICES
You should send any notices or other communications regarding MCP, its products or
services to FFEF, 724 Front Street, Suite 340, Evanston, WY 82930-3589.
MCP is a trademark of Credit Score Plus., a Utah corporation based in Layton, Utah.
FFEF may send any notices to you to the most recent e‐mail address you have
provided to us. If you wish to update your registration information, please log in to your
account and visit the 'Your Account' section from the main menu, and update any
address, email or other changes. Family Financial is not liable for any failure of a
consumer to update their personal information in the event information is sent to the
incorrect email or address..
AGE
Any individuals under the age of 18 are not allowed to create a My Credit Plan account.
You must be at least 18 to access any products through MCP as a member entitled to
membership benefits.
ARBITRATION
AGREEMENT TO RESOLVE DISPUTES BY BINDING INDIVIDUAL ARBITRATION
THIS SECTION IS AN AGREEMENT TO ARBITRATE DISPUTES ("ARBITRATION
AGREEMENT") THAT MAY ARISE AS A RESULT OF YOU’RE MCP MEMBERSHIP,
PRODUCTS OR SERVICES OR THE AGREEMENT. READ THIS SECTION
CAREFULLY. YOU UNDERSTAND AND AGREE THAT BOTH PARTIES WOULD HAVE
HAD A RIGHT TO LITIGATE DISPUTES THROUGH A COURT AND TO HAVE A
JUDGE OR JURY DECIDE THEIR CASE, BUT BOTH PARTIES BY ENTERING INTO
THIS AGREEMENT CHOOSE TO HAVE ANY DISPUTE RESOLVED THROUGH
BINDING INDIVIDUAL ARBITRATION. OTHER RIGHTS THAT YOU WOULD HAVE IF
YOU WENT TO COURT MAY NOT BE AVAILABLE OR MAY BE MORE LIMITED IN
ARBITRATION, INCLUDING YOUR RIGHT TO APPEAL.
YOU HAVE THE RIGHT TO REJECT THIS ARBITRATION AGREEMENT, BUT TO
EXERCISE THIS RIGHT PROMPTLY, You must notify us in writing within sixty (45)
days after the date you click‐on to "Accept" the Agreement. You must send your request
to: Family Financial, 724 Front Street, Suite 340, Evanston, WY 82931 AND INCLUDE
A PHOTO IDENTIFICATION.
YOU UNDERSTAND AND AGREE THAT NO CLAIM, DISPUTE OR CONTROVERSY
MAY BE CONSOLIDATED WITH A DISPUTE OF ANY OTHER PERSON IN
ARBITRATION, OR RESOLVED ON A CLASS‐WIDE BASIS BY A CLASS ACTION OR
OTHER PROCEEDING AND YOU HEREBY WAIVE YOUR RIGHT TO COMMENCE
OR PARTICIPATE IN ANY SUCH COLLECTIVE OR REPRESENTATIVE
PROCEEDING. Unless a different procedure is required by applicable law, arbitration
will be conducted before a single arbitrator in accordance with the rules of the American
Arbitration Association.
